Terms of Service – My Mirai770

1. General

The Website is operated under the trade name My Mirai770 by KS MEDIA, owned by Eliezer Keselman, Authorized Dealer No. 311367239 (hereinafter: the “Company” and/or the “Website Operator”). The term “Company” is used in these Terms for convenience only and does not indicate that the business is incorporated as a limited company.

About the Company's Activities

My Mirai770 is an online store specializing in the marketing and sale of a wide range of products in the fields of home, health, orthopedics, and quality of life.

The Company offers a variety of products and solutions intended to improve comfort and quality of life in everyday use, with an emphasis on quality, practicality, innovation, comfort, functionality, and a professional customer experience.

The range of products offered on the Website may be updated from time to time and may include, among other things, home products, comfort and lifestyle products, orthopedic products, and related accessories.

Products are marketed through the Website and supplied to Customers through a network of suppliers and shipping providers, including suppliers and warehouses located abroad.

Application of these Terms

These Terms of Service govern the relationship between the Company and any individual or entity browsing or using the Website or the information contained therein (hereinafter: the “User”).

The Company may update these Terms from time to time, including by adding or removing provisions, subject to applicable law. The updated version will be published on the Website. Transactions already completed will remain subject to the terms presented at the time of the transaction, and subsequent amendments will not deprive Customers of rights already acquired in connection with those transactions. Notice of changes will be provided where required by applicable law.

Use of the Website is subject to these Terms and applicable law. Nothing in the use of the Website or acceptance of these Terms constitutes a waiver of any right, claim or remedy that cannot lawfully be waived.

These Terms apply equally to all persons regardless of gender.

Prices and Products

Product prices include VAT where applicable and as required by law. Shipping fees and any additional charges, where applicable and lawfully chargeable, will be displayed before completion of the purchase in accordance with applicable price-display and disclosure requirements.

Product images displayed on the Website are for illustrative purposes. The Company will make reasonable efforts to display images and descriptions that accurately reflect the products. Minor differences may occur as a result of photography, screen settings or reasonable manufacturing variations. Nothing in this provision limits the Company's responsibility for product descriptions or any Customer rights relating to defects, misleading information or non-conformity with the product ordered.

The Company does not undertake to maintain inventory of every model or product displayed on the Website. If a product becomes unavailable after an order is placed, the Company will notify the Customer and handle the order in accordance with applicable law. A substitute product will not be supplied without the Customer's consent. Where the Company cancels the relevant transaction, the amount paid for the cancelled transaction will be refunded in full.

The Company may offer promotions and benefits and may modify or discontinue them, subject to their published conditions and applicable law, without affecting rights arising from transactions already completed.

Use of the Website

These Terms apply to use of the Website and its services through computers, mobile phones, tablets and other compatible devices.

Access to and use of the Website, including its content, information, products and services, are subject to these Terms and applicable law.

The Website and its content are intended for Users' personal, non-commercial use and for making purchases. Protected content may not be copied, reproduced, distributed, sold or commercially displayed without the prior written authorization of the relevant rights holder, except where permitted by law.

2. Legal Capacity

Any individual or entity making a purchase through the Website (hereinafter: the “Customer”) is required to read and accept these Terms, subject to the Customer's rights under applicable law.

Purchases are intended for persons aged 18 or over who are legally capable of entering into the relevant transaction. A purchase by or for a minor must be made with the approval of a parent or legal guardian where required by applicable law. A person acting on behalf of an entity must be authorized to bind that entity.

3. Applicable Law, Jurisdiction and Mandatory Rights

These Terms and transactions made through the Website are governed by the laws of the State of Israel, subject to any other mandatory provisions of law applicable to a particular transaction that cannot lawfully be excluded by agreement.

Disputes will be heard by courts having competent subject-matter and territorial jurisdiction in accordance with applicable law. Nothing in these Terms prevents a Customer from applying to a court that is legally competent to hear the matter.

Nothing in these Terms, including provisions relating to cancellation, shipping, warranties, returns, defective products, privacy or limitations of liability, excludes or restricts any consumer or other right that cannot lawfully be excluded or restricted. In the event of a conflict, the applicable mandatory legal provision will prevail.

Where mandatory consumer rights in the country of residence of a Customer outside Israel apply to a transaction and cannot lawfully be waived by agreement, those rights remain unaffected.

4. Intellectual Property

No protected part of the Website may be reproduced, copied, published, marketed, distributed or used to create derivative works without authorization, except where permitted by applicable law.

Rights in the domain name, Website design and intellectual property displayed on the Website, including trademarks, copyrights, patents and designs where applicable, belong to the Company or the relevant rights holders.

Access to the Website does not grant the User any license or ownership right in such intellectual property.

Product images, descriptions, trademarks and other materials appearing on the Website may belong to the Company or to third parties that have authorized their use. Display of a product on the Website does not imply that the Company owns all intellectual property rights in the product itself.

Users must refrain from unauthorized use of intellectual property belonging to the Company or any third party.

5. Commercial Warranty and Defective Products

In addition to any mandatory legal rights that may apply, My Mirai770 provides an additional commercial warranty for a period of 14 days from the date the product is delivered to the Customer, subject to proof of purchase. Shipping-carrier tracking information may be used to establish the delivery date, without preventing the Customer from demonstrating a different actual delivery date.

The commercial warranty applies to manufacturing defects and defects that existed when the product was delivered to the Customer.

A claim concerning a defect covered by the commercial warranty will be handled without charging the Customer for the covered remedy, through repair or replacement as appropriate to the circumstances and subject to the Customer's rights under applicable law. Where applicable law entitles the Customer to cancellation, a monetary refund or another remedy, the exercise of that right will not be conditional upon accepting repair or replacement.

The commercial warranty does not cover damage caused by circumstances unrelated to a manufacturing defect or a defect existing at delivery, including unreasonable use or use contrary to instructions. This may include damage resulting from accidents, falls, scratches or abrasions where such damage is not attributable to a covered defect.

For the purpose of investigating a claim, the Company may request proof of purchase, photographs, video or other information reasonably required to assess the claim. Such requests will not be used to deprive the Customer of mandatory rights under applicable law.

This 14-day commercial warranty is an additional store warranty only. It does not replace, shorten or restrict any statutory warranty, conformity right, cancellation right or other mandatory consumer right. Where applicable law provides a longer mandatory warranty or guarantee period, that period will apply in full. Expiration of the 14-day commercial warranty does not by itself extinguish such rights.

The Company may also offer paid repair services for repairable damage, subject to repair feasibility, availability of parts and the Customer's approval of the relevant quotation. Such paid services do not replace any repair or remedy that the Company is required to provide without charge under applicable law or the commercial warranty.

תקנון ותנאי שימוש באתר – My Mirai770

1. כללי

האתר פועל בשם המסחרי My Mirai770, תחת KS MEDIA, בבעלות אליעזר קסלמן, עוסק מורשה מספר 311367239 (להלן: "החברה" או "מפעילת האתר"). המונח "החברה" משמש בתקנון זה לשם הנוחות בלבד ואינו מציין כי העסק מאוגד כחברה בע"מ.

אודות פעילות החברה

My Mirai770 הינה חנות אונליין המתמחה בשיווק ומכירת מגוון מוצרים בתחומי הבית, הבריאות, האורתופדיה ואיכות החיים.

החברה מציעה מגוון מוצרים ופתרונות שנועדו לשפר את הנוחות ואיכות החיים בחיי היום־יום, תוך דגש על איכות, שימושיות, חדשנות, נוחות ופונקציונליות ועל חוויית לקוח מקצועית.

מגוון המוצרים באתר מתעדכן מעת לעת וכולל, בין היתר, מוצרים לבית, מוצרי נוחות ואורח חיים, מוצרים אורתופדיים ואביזרים משלימים.

המוצרים משווקים באמצעות האתר ומסופקים ללקוחות באמצעות מערך ספקים ושילוח, לרבות ספקים ומחסנים בחו"ל.

תחולת התקנון

תנאי שימוש אלה מסדירים את היחסים בין החברה לבין כל אדם או תאגיד הגולש באתר, משתמש בו או במידע המצוי בו (להלן: "המשתמש").

החברה רשאית לעדכן את התקנון מעת לעת, לרבות להוסיף או לגרוע הוראות, בכפוף לדין. הנוסח המעודכן יפורסם באתר. על עסקה שבוצעה יחולו התנאים שהוצגו בעת ביצועה, ואין בעדכון מאוחר כדי לגרוע מזכויות שנרכשו במסגרתה. הודעה על שינוי תימסר ככל שנדרש לפי דין.

השימוש באתר כפוף לתקנון ולהוראות הדין. אין בעצם השימוש באתר או ההסכמה לתקנון משום ויתור על זכות, טענה או סעד שלא ניתן לוותר עליהם לפי דין.

התקנון מנוסח בלשון זכר מטעמי נוחות בלבד והוא מתייחס לכל המגדרים באופן שווה.

מחירים ומוצרים

מחירי המוצרים כוללים מע"מ ככל שחל וכמתחייב לפי דין. דמי משלוח ותשלומים נוספים, ככל שחלים ומותר לגבותם, יוצגו לפני השלמת ההזמנה, בהתאם לחובות הצגת המחיר והגילוי שבדין.

תמונות המוצרים נועדו להמחשה. החברה תעשה מאמצים סבירים להציג תמונות ותיאורים המשקפים את המוצרים באופן מדויק. ייתכנו הבדלים קלים הנובעים מתנאי צילום, תצוגת מסך או שונות סבירה בייצור; אין בכך כדי לפטור את החברה מאחריות לתיאור המוצר או לגרוע מזכויות הלקוח במקרה של פגם, הטעיה או אי־התאמה למוצר שהוזמן.

החברה אינה מתחייבת להחזיק מלאי של כל הדגמים והמוצרים המוצגים באתר. אם לאחר ביצוע הזמנה יתברר כי מוצר אינו זמין, החברה תעדכן את הלקוח ותטפל בהזמנה בהתאם לדין. לא יסופק מוצר חלופי ללא הסכמת הלקוח, ובמקרה של ביטול מטעם החברה יושב מלוא התשלום בגין העסקה שבוטלה.

החברה רשאית להציע מבצעים והטבות ולשנותם או להפסיקם, בכפוף לתנאים שפורסמו ולהוראות הדין ומבלי לפגוע בזכויות בגין עסקאות שכבר בוצעו.

שימוש באתר

תנאי השימוש חלים על השימוש באתר ובשירותיו באמצעות מחשבים, טלפונים סלולריים, טאבלטים וכל מכשיר תקשורת מתאים אחר.

הגישה לאתר והשימוש בתכנים, במידע, במוצרים ובשירותים המוצגים בו כפופים לתקנון ולהוראות הדין החל.

האתר ותכניו מיועדים לשימוש אישי ולא מסחרי של המשתמשים ולביצוע רכישות. אין להעתיק, לשכפל, להפיץ, למכור או להציג באופן מסחרי תוכן מוגן מהאתר ללא אישור מראש ובכתב מבעל הזכויות, למעט שימוש המותר לפי דין.

2. כשירות משפטית

אדם או תאגיד המבצע רכישה באתר (להלן: "הלקוח") נדרש לקרוא את התקנון ולהסכים לתנאיו, בכפוף לזכויותיו לפי דין.

ביצוע רכישות מיועד לבני 18 ומעלה הכשירים לבצע את העסקה. רכישה עבור קטין או בידי קטין תיעשה באישור הורה או אפוטרופוס ובהתאם לדין. מי שפועל בשם תאגיד נדרש להיות מוסמך להתחייב בשמו.

3. הדין החל, סמכות שיפוט ושמירת זכויות

על התקנון ועל עסקאות באתר יחולו דיני מדינת ישראל, בכפוף להוראות דין מחייבות אחרות החלות על העסקה ושלא ניתן להתנות עליהן.

מחלוקות יידונו בבתי המשפט המוסמכים בהתאם לכללי הסמכות העניינית והמקומית הקבועים בדין. אין בתקנון כדי לשלול מהלקוח אפשרות לפנות לבית משפט המוסמך לדון בעניינו לפי דין.

שום הוראה בתקנון, לרבות בנושאי ביטול עסקה, משלוחים, אחריות, החזרות, פגמים, פרטיות או הגבלת אחריות, אינה גורעת מזכויות צרכניות או אחרות שלא ניתן להתנות עליהן לפי דין. במקרה של סתירה, הוראות הדין המחייבות יגברו.

ככל שעל עסקה עם לקוח מחוץ לישראל חלות זכויות צרכניות מחייבות במדינת מגוריו שאינן ניתנות לוויתור בהסכם, זכויות אלה יישמרו.

4. קניין רוחני

אין לשכפל, להעתיק, לפרסם, לשווק, להפיץ או ליצור יצירות נגזרות מחלק מוגן באתר ללא הרשאה, למעט שימוש המותר לפי דין.

הזכויות בשם המתחם, בעיצוב האתר ובקניין הרוחני המוצג בו, לרבות סימני מסחר, זכויות יוצרים, פטנטים ומדגמים ככל שקיימים, שייכות לחברה או לבעלי הזכויות הרלוונטיים.

עצם הכניסה לאתר אינה מעניקה למשתמש רישיון או זכות בעלות בזכויות אלה.

תמונות, תיאורי מוצרים, סימנים וחומרים נוספים המוצגים באתר עשויים להיות בבעלות החברה או צדדים שלישיים שהרשו את השימוש בהם. הצגת מוצר באתר אינה מעידה כי החברה היא בעלת כל זכויות הקניין הרוחני במוצר עצמו.

המשתמש מתחייב להימנע משימוש בלתי מורשה בזכויות החברה או צדדים שלישיים.

5. אחריות מסחרית ומוצרים פגומים

My Mirai770 מעניקה אחריות מסחרית נוספת למשך 14 ימים ממועד מסירת המוצר ללקוח, כנגד הוכחת רכישה. נתוני המעקב של חברת השילוח ישמשו לצורך בירור מועד המסירה, מבלי לשלול אפשרות להוכיח מועד מסירה בפועל שונה.

האחריות המסחרית חלה על פגם בייצור או פגם במוצר שהיה קיים בעת מסירתו ללקוח.

פנייה בגין פגם המכוסה באחריות תטופל ללא חיוב הלקוח בגין הטיפול המכוסה, באמצעות תיקון או החלפה, בהתאם לנסיבות ולזכויות הלקוח לפי דין. כאשר הלקוח זכאי לביטול ולהחזר כספי או לסעד אחר לפי דין, לא יותנה מימוש זכותו בהסכמה לתיקון או להחלפה.

האחריות המסחרית אינה מכסה נזק שנגרם מסיבה שאינה קשורה לפגם בייצור או לפגם שהיה קיים במסירה, כגון שימוש בלתי סביר או שימוש בניגוד להוראות. בכלל זה, היא אינה מכסה נזק שנגרם מתאונה, נפילה, שריטות או שפשוף, ככל שהנזק נובע מאירועים אלה ולא מפגם מכוסה.

לצורך בירור פנייה החברה רשאית לבקש הוכחת רכישה, תמונות או סרטון וכן מידע נוסף הנדרש באופן סביר לבדיקתה. דרישות הבירור לא ישמשו לשלול זכויות לפי דין.

אחריות זו היא אחריות מסחרית נוספת בלבד. היא אינה מחליפה, מקצרת או מגבילה אחריות חוקית, זכויות בגין פגם או אי־התאמה, זכות ביטול או כל זכות אחרת לפי דין. אם חלה על המוצר תקופת אחריות מחייבת ארוכה יותר, היא תחול במלואה. תום 14 הימים אינו שולל כשלעצמו זכויות אלה.

בנוסף, החברה עשויה להציע שירות תיקונים בתשלום לנזקים בני תיקון, בכפוף לבדיקת היתכנות התיקון, זמינות חלקים ואישור הצעת מחיר בידי הלקוח. שירות זה אינו מחליף טיפול ללא תשלום שהחברה חייבת לספק לפי דין או לפי האחריות המסחרית.
